Passenger Conduct, Vehicle Care & Additional Charges Agreement

Agreement version 2026-09-passenger-1
Passenger Conduct, Vehicle Care & Additional Charges Agreement This agreement governs the use of chauffeured transportation provided by 805 VIP Transportation LLC ("805 VIP") to the customer or booking party ("Customer"). By accepting this agreement or using the service, the Customer agrees to these terms and is responsible for ensuring that every passenger in the Customer's party follows them. 1. Vehicle Care and Responsibility The Customer and all passengers must exercise reasonable care while using the vehicle. Smoking, vaping, illegal activity, dangerous conduct, and any activity reasonably likely to damage or excessively soil the vehicle are prohibited. The Customer is responsible for damage or excessive cleaning caused by the Customer or any passenger in the Customer's party, including damage caused by negligence, spills, burns, stains, broken equipment, or misuse of the vehicle. 2. Reporting Damage Any known damage must be reported immediately to 805 VIP or the assigned chauffeur. The Customer must provide accurate information concerning the incident and, when reasonably available, relevant photographs or other evidence. 3. Liability for Damage and Additional Charges The Customer is responsible for the reasonable cost of cleaning, repair, or replacement for damage caused by the Customer or the Customer's passengers. 805 VIP will document the condition and provide an invoice or reasonable estimate. Payment is due within the timeframe stated on that invoice. Related towing, storage, loss-of-use, and reasonable administrative costs may also be charged when directly resulting from the damage. If repair is not commercially reasonable or the vehicle is deemed a total loss, liability will not exceed the legally recoverable replacement value and related costs. 4. Insurance 805 VIP maintains insurance required for its operations. The Customer understands that 805 VIP's insurance may not cover damage caused by the Customer or the Customer's passengers. To the extent permitted by law, the Customer remains responsible for uncovered amounts caused by that conduct. 5. Indemnification To the fullest extent permitted by California law, the Customer agrees to indemnify and hold harmless 805 VIP, its employees, chauffeurs, and affiliates from third-party claims, liabilities, damages, or reasonable costs arising from the Customer's or the Customer's passengers' conduct, except to the extent caused by 805 VIP's gross negligence or willful misconduct. 6. Alcohol, Drugs, and Unsafe Conduct Passengers may not possess or use illegal drugs in a vehicle. Passengers may not enter or remain in a vehicle when their intoxication, impairment, conduct, or possession of a prohibited substance creates a safety risk or violates applicable law. The chauffeur may refuse or discontinue service when the chauffeur reasonably believes a passenger presents a danger to themselves, other passengers, the public, the chauffeur, or the vehicle. Refusal or discontinuation of service for unsafe or unlawful conduct does not create an automatic right to a refund. 7. Lost or Damaged Personal Property Passengers are responsible for their personal belongings and valuables. 805 VIP and the chauffeur are not responsible for lost, stolen, forgotten, or damaged personal property except where liability cannot legally be excluded. 8. Wait Time, Overages, and No-Shows Unless a written vehicle-specific policy states otherwise, reservations include up to one complimentary hour of waiting time beginning at the scheduled pickup time. After the complimentary period, waiting time is charged at $75 per hour in 15-minute increments ($18.75 per 15 minutes). Charges begin after the first hour and continue until the vehicle departs or service concludes. Party Bus service has no complimentary grace period. Party Bus wait time and overage are charged at $195 per hour, billed in one-hour increments, unless a different written rate is shown on the accepted quote. If the Customer does not arrive within the applicable grace period and has not communicated with 805 VIP, the reservation may be treated as a no-show. The full reservation amount and applicable waiting charges may be due under the cancellation and no-show policy attached to the accepted quote. 9. No Smoking or Vaping Smoking and vaping, including electronic cigarettes and similar devices, are strictly prohibited inside every vehicle. Passengers may not ask or offer additional compensation to a chauffeur to disregard this rule. 10. Governing Law and Venue This agreement is governed by the laws of the State of California. To the extent permitted by law, disputes arising from this agreement will be brought in a court of competent jurisdiction in Ventura County, California. 11. Relationship to Quote and Cancellation Terms This agreement supplements the itinerary, price, vehicle-specific rules, cancellation policy, and other terms shown on the Customer's accepted quote. If a vehicle-specific written term conflicts with this agreement, the vehicle-specific term controls only for that reservation. Electronic acceptance is binding. 805 VIP records the agreement version, date and time, network address, and browser information as evidence of acceptance.
